Acceptance of Terms

These Terms of Service apply to every app published by Lometics GmbH, Gaiserau 39, 9056 Gais, Switzerland (“we”), including Themia, Gloomia and tabls (each the “Application”), and to the websites lometics.com, themia.app, gloomia.app and tabls.app. By downloading, installing, buying or using an Application, you agree to these terms. If you do not agree, do not use the Application.

How you may use the Application itself is set out in the End User License Agreement. How we handle personal data is set out in the Privacy Policy.

What you buy

• Buy once. Our Applications are never sold as subscriptions. A purchase is a one-time payment for a version of the Application, and the license for that version does not expire.
• Fixed price. What you paid for a version is paid. There are no later price increases or fees for something you already own.
• Source available. The source code of our Applications is, or will be, published so you can read what you run. Its use is governed by the license in its repository.
• Free versions. Where an Application has a free version, its limits are described on the Application’s website or store listing.
• Updates. Updates within the major version you bought are free. A new major version with new features may be a separate purchase, and you decide whether to buy it.
• Changes. We may improve and change the Applications over time. We will not take away a feature you paid for in your version through an update.

Purchases and Refunds

• Microsoft Store: licences for our Applications are sold through the Microsoft Store and processed by Microsoft. Payment, tax, invoicing and refunds follow the Microsoft Store terms and refund policy.
• Earlier purchases: licence keys bought on our websites before the move to the Microsoft Store remain valid under these terms.
• If you have a problem with a purchase, write to us first at info@lometics.com. We will help.

Acceptable Use

You may not:

• Use the Application for any unlawful purpose
• Redistribute, sublicense or resell the Application or your license
• Attempt to bypass or circumvent license verification
• Reverse engineer, decompile or disassemble the Application, except where applicable law or the source license expressly permits it

Disclaimer of Warranties

To the extent permitted by applicable law, the Application is provided “as is”, without warranty of any kind, express or implied. We do not warrant that the Application will be uninterrupted, error-free or free of harmful components. Statutory rights you have as a consumer are not affected.

Limitation of Liability

To the extent permitted by applicable law, we are not liable for any indirect, incidental, special, consequential or punitive damages arising from your use of the Application. Liability for intent and gross negligence, and any liability that cannot be excluded by law, remains unaffected.

Changes to These Terms

We may update these terms from time to time; the date at the top always reflects the current version. Changes never take away rights you already have for a version you bought.

Governing Law

These terms are governed by the laws of Switzerland. The place of jurisdiction is the seat of Lometics GmbH. If you are a consumer, the mandatory consumer protection rules and courts of your country of residence remain available to you.
